General Terms and Conditions (GTC) for orders via www.ohanies.ch
Below we would like to introduce you to our general terms and conditions, which we use as a basis for processing and handling your purchase.
We offer you on https://www.ohanies.ch the purchase of Ohanies items and OhaniesPartner items.
Ohanies items are all items that we offer you on www.ohanies.ch, as long as we do not inform you that it is an Ohanies partner item.
Ohanies partner articles are articles that we offer you on www.ohanies.ch offer and mark it as a partner article with a note.
1.Conclusion of contract and delivery of goods
1.1 Contracts via www.ohanies.ch We conclude contracts exclusively in German and English. When ordering Ohanies products, your contractual partner is Ohanies GmbH, Höhenstrasse 35, 8620 Wetzikon. When ordering Ohanies partner products, your contractual partner is also the respective Ohanies partner, whose identity we will inform you about individually on the respective product detail page.
1.2 By clicking the "Buy now" button, you place a binding order for the items in your shopping cart. We will confirm receipt of your order immediately by email after you submit your order. A binding contract is concluded upon receipt of the order confirmation. Please note that with advance payment (reservation), the ordered goods will be delivered as soon as we receive payment of the full purchase price, including any shipping costs. Therefore, we ask you to transfer the purchase price immediately after receiving the order confirmation, but no later than within 7 days.
1.3 Please note that, as an exception, we are not obligated to deliver the ordered goods if we have properly ordered the goods ourselves, but have not been delivered correctly or on time. This is provided that we are not responsible for the unavailability of the goods and that we have informed you of this fact immediately. If the goods are subsequently unavailable, we will promptly refund any payments already made.
1.4 We do not assume the risk of having to procure ordered goods (procurement risk). This also applies to orders for goods that are only described by their type and characteristics (generic goods). We are only obligated to deliver from our inventory and from the goods we order from our suppliers. For orders of OhaniesPartner items, our inventory includes the inventory of the Ohanies Partner. We deliver orders within Switzerland. When delivery times are specified as working days, this means all days from Monday to Friday, excluding public holidays.
2. Prices and shipping costs
2.1 The prices listed in the offer at the time of the order apply. The prices stated are final prices, i.e., they include the applicable statutory value-added tax.
2.2 Shipping costs are CHF 8.50 for B Post or CHF 10.50 for A Post within Switzerland. Postage may vary for international shipments.
2.3 Different shipping charges may apply for the shipping of particularly bulky, heavy or valuable items, which we will specify for each product individually on the product detail page and on the order page during the sale.
3.Payment
3.1 We generally offer payment in advance, credit card, and Twint. We reserve the right to refuse certain payment methods for each order and to refer to other payment methods. Please note that we only accept payments from accounts in Switzerland and within the European Union (EU). You are responsible for any fees associated with a money transaction.
3.2 In the case of purchase by credit card, your credit card account will be debited when we ship the order.
3.3 You agree to receive invoices, credit notes and reminders in electronic or paper form.Â
4. Promotional vouchers and their redemption
4.1 Promotional vouchers are vouchers that cannot be purchased, but which we issue as part of advertising campaigns with a specific period of validity.
4.2 Promotional vouchers can only be redeemed during the specified period and only once per order. Certain branded products may be excluded from the voucher promotion. Promotional vouchers cannot be used to purchase gift vouchers. Please note that promotional vouchers may be subject to a minimum order value.
4.3 The value of the goods must be at least equal to the amount of the promotional voucher. Any difference to a higher value of the goods can be settled using the payment options offered. The value of a promotional voucher is neither redeemable in cash nor bears interest. The promotional voucher will not be refunded if the goods are returned in whole or in part.
4.4 Promotional vouchers can only be redeemed before completing the order process. Retroactive crediting is not possible. The promotional voucher cannot be transferred to third parties. Multiple promotional vouchers cannot be combined unless we have agreed otherwise.
4.5 If you used a promotional voucher for your purchase, we reserve the right to charge you the original price of the goods you keep if – due to your cancellation – the total value of the order falls below the respective value of the promotional voucher.
5.Gift vouchers and their redemption
5.1 Gift vouchers are vouchers that you can purchase. These can only be redeemed for Ohanies items and Ohanies partner items, not for the purchase of additional gift vouchers. If the balance on a gift voucher is insufficient for the order, the difference can be made up using the payment options offered.
5.2 Gift vouchers and credit balances can only be redeemed before completing the order process. Gift voucher balances are neither redeemable in cash nor accrue interest. To redeem gift vouchers in your customer account or view existing balances, please visit "My Vouchers and My Balance" at www.ohanies.ch.
6. Return policy for Ohanies items and Ohanies partner items
For all purchases of Ohanies items at www.ohanies.ch, Ohanies grants a voluntary right of return of 14 days from receipt of the goods. You can then withdraw from the contract by returning the goods to us within 14 days of receipt (the period begins on the day after receipt of the goods). Timely dispatch is sufficient to meet the deadline. However, the prerequisite for exercising the right of return is that you have only worn the goods for fitting, as you would in a store, and that you return the goods complete and undamaged. We also ask that you return the goods to us in their original packaging. The customer is responsible for the return postage. The right of return does not apply to the purchase of gift vouchers, provided they are already stored in the user account, and does not apply to contracts for the delivery of goods that, due to their nature, are not suitable for return (such as opened cosmetic products for hygiene reasons). 9. Statutory liability for defects and further information
9.1 The statutory warranty for defects applies. Ohanies expressly reserves the right to provide the buyer with a defect-free replacement in the event of asserted and identified defects in the purchased item.

10. Applicable law and place of jurisdiction

The UN Convention on Contracts for the International Sale of Goods (CISG) and any other intergovernmental agreements do not apply. For contracts concluded for a purpose that cannot be attributed to the professional or commercial activity of the authorized party (contracts with consumers), this choice of law applies only to the extent that the protection granted is not withdrawn by mandatory provisions of the law of the country in which the consumer has his or her habitual residence.Â
11.2 With regard to consumers, the place of jurisdiction shall be the Swiss domicile of the

In this case, we are also entitled to sue at the customer's place of residence.
